1. Acceptance of terms
Please read these Terms carefully. This page sets out the terms and conditions ("Website Terms") on which we, Quick Menu ("we", "us" or "Quick Menu"), provide services through our website www.quickmenu.com.au and any Quick Menu mobile application through which you access our services.
By accessing or using the Quick Menu Platform, you are agreeing to these Terms and concluding a legally binding contract with Quick Menu. and/or its affiliates.
In order to use the Quick Menu Services, you must first agree to the Terms. You may not use the Quick Menu Services if you do not accept the Terms or are unable to be bound by the Terms. Use Quick Menu Platform at your own risk, including the risk that might expose you to content that is objectionable, or otherwise inappropriate.
User
"User" or "You" or "Your" refers to you, as a user of Services. A user is someone who accesses or uses the Quick Menu Services
Restaurant(s)
"Restaurant" means the restaurants listed on Quick Menu.
2. Modifications
Quick Menu reserves the right to modify the terms and conditions of this Agreement. You should regularly review this Agreement, as your continued use of the Services after any such changes constitute your agreement to such changes.
3. Eligibility to use the services
By using our services, you warrant that you are at least eighteen (18) years of age or above and are fully able and competent to understand and agree on the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms.
4. The Services
The Services comprise website and mobile services which enable users to reserve a restaurant table and placing dine-in order.
4.1. Terms of permitted use:
You are permitted to use the Quickmenu website and application. You may print and download extracts from the Website or mobile application for your own personal non-commercial use on the following basis:
4.1.1. You must not misuse the Website or mobile application (including by hacking or "scraping").
4.1.2. Unless otherwise stated, the copyright and other intellectual property rights in the Website and mobile application and in the material published on it (including without limitation photographs and graphical images) are owned by us or our licensors. Each and every content on the website and mobile application is protected by copyright laws and treaties and all rights are reserved. Any use of extracts from the Website or mobile application other than in accordance 4.1 is strictly prohibited.
4.1.3. You must not misuse the digital or paper copies of any materials that you print of including pictures, photographs, or any other graphics, video, or audio sequences.
4.1.4. You are not allowed to use any of the materials on the Quick menu website or mobile application for commercial purposes without obtaining a license from us.
4.2. Reservation of rights: Any rights not expressly granted in these quick menu Terms are reserved
5. Service Access
5.1. Website mobile application is normally available twenty-four (24) hours a day, we do not undertake any obligation to do so, and we will not be liable if our website or mobile application is unavailable at any time for use.
5.2. Access to our services may be suspended temporarily at any time and without notice.
5.3. The transmission of your data via the internet is not completely secure. Although we take all the necessary steps required by law to protect your data.
6. Third-Party Services
The Site may include links to other sites, applications, and platforms solely for your convenience. If you use the third party websites it means you leave our platform.
The Quick Menu does not control the Linked Sites, and shall not be responsible for their content and other materials.
If you decide to access any of the third-party websites linked, you do so that entirely at your own risk.
7. Indemnification
You agree to indemnify, defend and hold harmless the Quick Menu, its offices, managers, directors, employees, agents, and third parties, for any losses, claims, actions, costs, damages, penalties, fines and expenses (including attorneys' fees), liabilities regarding or arising out of your enjoyment of or inability to enjoy the Site or its services and Company’s services and products or platforms, your violation of the Terms or your violation of any rights of third parties, or your violation of the applicable law. The Company Quick menu reserves the right, to assume the exclusive defense and you shall fully cooperate with the Company in asserting any available defenses.
8. Disclaimer of Warranties
YOU ACKNOWLEDGE AND AGREE THAT TO THE FULLEST EXTENT OF LAW, YOUR USE OF THE COMPANY PLATFORM AND IT’S SERVICES ENTIRELY AT YOUR OWN RISK. CHANGES ARE PERIODICALLY MADE TO THE PLATFORM AND IT’S SERVICES AND MAY BE MADE AT ANY TIME WITHOUT NOTICE TO YOU.
QUICK MENU DOES NOT WARRANT YOU THAT IT’S SERVICES WILL OPERATE ERROR-FREE OR THAT THE WEBSITE OR MOBILE APPLICATION ARE FREE OF COMPUTER VIRUSES AND OTHER HARMFUL MALWARE. IF YOUR USE OF THE WEBSITE OR MOBILE APPLICATION RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, QUICK MENU SHALL NOT BE RESPONSIBLE FOR THOSE ECONOMIC COSTS.
THE QUICK MENU PLATFORMS AND SERVICES THAT ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. QUICK MENU MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS OR TIMELINESS OF THE CONTENT TEXT, GRAPHICS, OR LINKS AVAILABLE ON THE QUICK MENU WEBSITE OR MOBILE APPLICATION.
9. Communications
By creating a Quick Menu account, you electronically agree to accept and receive communications from Quick Menu, Contractors, or third parties including via email, text message, calls, and push notifications to the cellular telephone number you provided while creating an account or using Quick Menu services.
If you do not wish to receive promotional emails, text messages, or other communications, you may opt-out or manage your preferences by accessing the settings in your account.
For purposes of clarity, reservation or order placement text messages between you and Quick Menu Services are transactional text messages, not promotional text messages.
10. Force Majeure Event
We will not be liable or responsible for any failure to serve, or delay in performance of, any of our obligations under these Website Terms that is caused by events outside our reasonable control ("Force Majeure Event").
A Force Majeure Event includes any act, event, non-occurrence, omission, or accident beyond our reasonable control and includes in particular (without limitation) the following, war, terrorism, earthquakes, hurricanes, acts of government, explosions, fire, plagues, or epidemics or other natural disasters; the impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; the impossibility of the use of telecommunications networks; and the acts, decrees, legislation, regulations or restrictions of any government. Our performance under these Quick Menu Terms is deemed to be suspended for the period that any Force Majeure Event continues.
11. Miscellaneous
The governing law of the Terms shall be the substantive laws of the country where the Company is set up, except the conflict of laws rules. You shall not use the Site in jurisdictions that do not give effect to all provisions of the Terms.
Nothing in the Terms shall be an exemption from or relaxation of a rule or law of the Company's right to comply with governmental, court, police, and law enforcement requests or requirements regarding your enjoyment of the Site.
If any part of the Terms is determined to be void or unenforceable in accordance with applicable law then the void or unenforceable clauses will be deemed superseded by valid and enforceable clauses shall be similar to the original version of the Terms and other parts and sections of the Terms shall be applicable to you and the Company.
The Terms constitute the entire agreement between you and the Company regarding the enjoyment of the Site and the Terms supersede all prior or communications and offers, whether electronic, oral or written, between you and the Company.

Any complaint, with respect to the food availability in the restaurant or reservation time slot availability before confirmation or foreign objects in food, wrong order, You will be required to take it up directly with the Restaurant and Quick Menu shall not be liable for any such instances.
